Remember the Fairness Doctrine? The one that the libtards in and out of Washington want to resurrect? The theory behind the Fairness Doctrine is:

radio stations could be regulated in this way due to the limited spectrum of the public airwaves.

It was, in other words, a government-created scarcity that justified government regulation. Much like the government-created gasoline scarcities under Nixon and Carter.

Now a whacko Goremon named Mary Wood is asserting that the air is held in trust by the government.

University of Oregon law professor Mary Wood is tired of waiting for government officials to take action on global warming. So she’s devised a new legal tool to hurry them up.

Drawing on her background in both natural resources and property law, Wood has developed a theory that claims the atmosphere is an asset that belongs to all but is held in trust by the government. The government has a legal obligation to protect that trust from harm, she argues, just as financial managers have a legal obligation to protect the monetary assets in their care.

I’m sure that BMEWS readers have figured where this is going…

“The main problem with climate is that no government is taking responsibility for it and our government is sitting idle while this catastrophe is unfolding,” Wood said.

“There’s no other body of law that requires the government to act. But a trustee has to act to protect the body of the trust.”

Yep. And the laws are already on the books. No need to debate!

From theory to practice

Greg Costello is one of the public interest attorneys evaluating Wood’s proposal as the basis for potential lawsuits. He thinks it could be a successful legal strategy because it’s grounded in a widely accepted principle of common law.

“Public trust doctrine is a doctrine everybody learns in law school. It goes back to Roman times,” said Costello, executive director of the Eugene-based Western Environmental Law Center.

“It’s a theory that seems well-suited and perhaps ideal when you’re talking about who owns the atmosphere.”

Families are furious about plans by a council’s bin police to question them about their medical history.

Officials in Plymouth, Devon, are to send a questionnaire to every household asking them to give intimate personal details about their family.

Householders are also being asked to nominate one person who will take legal responsibility for anything put in their bins.

Waste of time: Residents are furious because there is no way they can stop other people using their bins

The council is even asking how many children families have and whether they use disposable nappies.

The forms are to be sent to all homes in the city as part of a ‘zero tolerance’ policy on bins.

The council wants to increase fixed penalties from £50 to £110 for those who put bins out early, fail to recycle, overfill wheelie bins or put the wrong rubbish in the wrong containers.

They are asking each household to nominate one person as responsible so it will be easier for them to prosecute without having to prove who put out the offending bins.

The council is also considering interviewing suspected bin offenders under caution in procedures similar to the way police question criminals.

The draft letter, which has been seen by opposition councilors, also asks how many people live at each address, whether they have any medical conditions and if their families use disposable nappies.

Officials from the Conservative-run council hope the information sent back by families will make it easier to prosecute or impose fixed penalties.

It follows the failure of a pioneering prosecution by Exeter City Council 45 miles away which failed because they could not prove that household waste in a recycling bin was put there by the householder.

Young mother ordered to pay £265 for putting bin out 24 hours too early

Timing is everything as Zoe Watmough has found to her cost after putting her bins out a day early.

As a result, the 22-year-old mother was hauled before magistrates and handed down a legal bill of £265.

Council officers spotted her two bins - a green one for recycling and a grey one - on a Wednesday, 24 hours before it was due to be collected.

The rules of Bolton Council in Greater Manchester dictate bins should not be put out until after 7.30am on the day refuse collectors are due.

At Bolton magistrates court Zoe was fined £125, ordered to pay £125 costs and a £15 victim surcharge.

The court was told the council is pursuing prosecutions over bins left on streets because of the number of arson attacks by youths in the area.

It is estimated the cost of attending a bin fire is £1,900, and they cost the fire service up to £3million each year across the country.

But at home Zoe said: “I am flabbergasted.

“There are people committing all sorts of crimes and getting away with it. Yet I have left my bin out and have been fined the best part of £300.

“Everybody in this area puts their bins out the day before collection. I don’t see what the problem is and can’t afford to pay the fine.”

The court heard Miss Watmough had already been sent a warning by council officers who spotted last November that her bins were out before collection day.

When they spotted them out on a second occasion - in January - Miss Watmough was given a £75 fine. That resulted in a prosecution because she did not pay it within seven days.

Run-ins with councils over bin collection and their contents are not unusual.

Retired milkman Barry Freezer recently made the mistake of dumping cabbage stalks in his bin and incurred the wrath of the council’s waste collection supremos.

The 73-year-old says they treated him like a criminal and refused to collect his garden waste, claiming the cabbage trimmings were kitchen rubbish.

The binmen were following an obscure rule that forbids food that may have come into contact with meat from being mixed with garden waste for composting, to prevent outbreaks of diseases such as foot and mouth.

The week before it emerged the same council had refused to empty the bin of partially sighted ex-Desert Rat Lenny Woodward, 95, because he put a ketchup bottle and an empty coffee jar in the wrong bin.

Health and safety zealots say a 2ft paddling pool needs a lifeguard

For nearly a quarter of a century, Lourdes Maxwell has celebrated the arrival of summer by putting a paddling pool in the garden.

This year, however, her two grandchildren and the children of her neighbours may have to find another way to cool off in the heat.

Miss Maxwell’s local council has decided that the pool - which is only 2ft deep - needs a lifeguard.

The 47-year-old divorced mother of three has also been told she must have insurance before she can inflate the toy outside her house in Portsmouth.

The health and safety edict came after she wrote to the city council asking for permission to put a bigger pool in the communal garden outside her home.

Not only was she told it was too dangerous, but the council told her to empty the existing pool.

After her MP intervened, the local authority softened its stance, saying Miss Maxwell could have a pool if she paid for insurance and ensured supervisors were on constant watch.

Residents near the communal gardens already have to obey a raft of rules governing their use.

They are even supposed to ask the council for permission before having a barbecue.

Miss Maxwell, who is a full-time carer to her son Aiden, said yesterday: “It is absolutely pathetic.

“I have had a paddling pool outside the front of my flat every summer for 24 years, ever since Aiden turned one year old.

“Neighbours’ children would come and enjoy the pool and I would give them ice lollies. It was always a very social occasion.”

She added: “Now suddenly I’m not allowed.

“I asked around for insurance and they just laughed at me. No one offers insurance for paddling pools.

“I’m always there to supervise but they’re trying to tell me I need lifeguards for a kiddies’ pool as well - it’s crazy.”

Nigel Selley, Portsmouth Council’s neighbourhood manager, defended the ruling yesterday.

He said: “We did not have sufficient assurances that the risks associated with providing such a facility would be well-managed.

“We have since spoken to Ms Maxwell and she is aware of our concerns for child safety and the risks associated with drowning.”

Steven Wylie, the councillor in charge of housing, added: “I want to encourage people to enjoy the communal gardens.

“We want to help where we can to ensure that it is a fun and safe place for everyone to use.”

HAS THE NANNY STATE ATTITUDE FINALLY REACHED THE SHORES OF THE USA?

BMEWS readers will note that last week I posted an incredibly STUPID account of Nanny state behavior being adopted by a major supermarket chain here in the UK.

With absolute certainty that it “could not happen in the USA” and if it did the consequences might be dire, I posted sure of my position.

Boy was I WRONG!  I’ve been away from my home country since 2004, and apparently things are in the crapper there as well on this subject.

Where a clerk in a store can refuse to sell to an adult buying liquor just because they are in the company of a minor.  In other words, you’re quilty without a hearing no matter that the minor is your very own daughter. 

I sent that story and my comments to a long time friend in the USA, and got this response.

Must have similar laws here. A friend told me recently she was at a

liquor store with her 20 (soon to be 21) year old daughter. They were

talking about the daughter’s trip to Germany and France and the

daughter was saying how wine is commonly served to older teenagers at

restaurants with their parents - or something along those lines. When

they got to the check out, the clerk refused to sell them the liquor,

saying that she overheard their conversation and it sounded like my

friend was buying it for her underage child. Oh - and the clerk saw

the daughter ‘touch’ one of the bottles. Needless to say, my friend
was both mortified and furious.

YOU KNOW THINGS ARE IN THE CRAPPER WHEN A MAJOR CORP. BECOMES NANNY TO ALL.

This story is about the worst bit of nanny-ism I’ve come across so far.  Bad enuff big brother govts. like to play that game.  But when a company like this, and it is a very MAJOR one, can get away with this crap .... well then .... I just don’t know what else to say. I believe it’s stupid, I don’t believe it’ll achieve it’s aim and it’s sure to anger many.

Now then, this company is opening stores in the USA I want ya to know.  I’d like to see them try and get away with this crap in the USA.  Or do ya suppose they already know better.  But the Brits bless em ,,, they’ll probably go along with the program.  The rest like Lyndon and Chris will leave for Canada.

This is so bizarre I’m gonna resist the temptation to add anything between lines.  But DREW .... be my guest.  I think you’d keep a cooler head then I.

Tesco ban on alcohol sales to parents

Tesco is refusing to sell alcohol to parents shopping with their children under rules designed to tackle underage drinking.
The supermarket has told cashiers not to supply alcohol if they suspect an adult is buying the drink for an underage youth.

Staff have been told to “err on the side of caution” when interpreting the policy, leading to cases of parents out shopping with their children being told to put alcohol back on the shelves.

Tesco says it believes parents will support the policy and it would rather apologise where it has misjudged the situation than sell to underage drinkers.

However parents who have been refused alcohol have described the rule as humiliating and daft.

Debbie Bell, 39, a housewife from York, was told she could not buy a crate of lager at a Tesco Extra in the city with her stepson Michael Bruce, 18.

Mr Bruce, a student, was unable to show the cashier any proof of his age and his mother was told to put the 24 cans of Fosters and a bottle of cider back on the shelf.

She said: “You can’t do that just because somebody has kids with them.

“I was in there the day before with a 17-year-old lass and there were no problems.

“Michael wasn’t even carrying the beer, he was just standing next to me.”

Dominic Zenden, a television medium, was told he could not buy six bottles of Budweiser beer when he was accompanied by his 15-year-old daughter Devon.

A cashier at the shop in Sprowston, Norwich, refused to believe Mr Zenden, who has his own series on Sky television, was not going to share the drink with his daughter.

He said: “I was dumbfounded. There was absolutely no indication that my daughter would be drinking the alcohol – it was for me.

”But the woman told me that they don’t sell alcohol to people who have children with them.”

Mr Zenden, 45, who lives in Norwich, added: “They haven’t got signs up to say that they won’t sell to people who have their children with them. If they did it would save a lot of embarrassment at the till.”

The supermarket said it had bought in the policy because a crackdown on selling directly to underage teens had been so successful, youths were now forced to rely on friends, parents and relatives for alcohol.

A Tesco spokesman said: “I can understand the frustrations of the customer but I think that any reasonable parent would understand the problem and support our policy.”

Health and Safety and National Suicide in the PC Twilight Zone

I’m not certain how to title the story I wanna write.  The article here is probably the shortest story I’ve ever posted. My comment will take more room then the article.  But I just have to post this so it can be added to all the other wild assed moonbat things that a handfull of Brits are doing to their country.

First guys ... an explanation.  Back home (USA) if someone delivers papers it’s a paper route. Well over here, it’s called a “round.”
Same for the guy who delivers our milk. It’s a milk round. 
So,,, one day we got a notice that Ken, that’s the fellow who delivers our milk from the dairy, is going on vacation holiday for a week and that our usual good service will continue.  But what got to me was the oh so politically correct language used to tell us that .........

“Your Roundperson will be on holiday.” Fraken ROUNDPERSON?  A roundperson?  Have you ever heard anything more STUPID sounding then that?
Does that tell you anything about the direction this country has been FORCED to take?  Trust me folks.  The average Brit is NOT THAT STUPID!  Heaven only knows the why or how of things but the fact is ... this place is becoming a pc Twilight Zone.

Now then .... regulars of this site have read my past stories with regard to Health and Safety laws here.  Like barbers who can’t use a straight razor, cops who can not use a slim jim to get ppl out of locked cars, all due to Health and Safety regs.  And you’ve read here how stupidly tiresome it is to get a simple Rx filled and the hoops ya have to jump thru.

Of course, the Brits have been doing some things for so long they haven’t any idea how easy some basic things could or should be.  And the holy of holy mantras is .... Health and Safety.

Safety? Good grief Charlie Brown, their streets aren’t safe and neither are their homes. 
Well anyway ....Here we are again with another H & S thingy.

Look, I’m all for safe environments for the kiddies.  I don’t much care for em as a rule but I don’t wanna see em hurt either. But this article doesn’t really tell us much, does it?  Of course, we’re kind of rural and our paper is delivered via car with an adult. But this newest thing sure does appear like all the other ...
“It’s for the kids” kind of rules and regs.

Seems ta me that if Health and Safety were really top of the pops with the folks who makes rules and laws and such, you’d think they’d be a hollerin’ and screaming about the many lawless let out of jails who go on to do more crimes.  You’d think, being a reasonable person, that anyone who’d try and poison her own 7 year old daughter would spend enuff time in the slammer that she couldn’t get out to then try and poison another person. Right? But oh no. Now she’s back in jail for trying the same with hubby.

OK, that’s my say. For now anyway. Cue the music for T.Zone

Paper rounds threatened by safety checks

Paper rounds are under threat from rules forcing shopkeepers to have safety checks, the Federation of Small Businesses said on Friday.
Thousands of young people face being laid off as newsagents axe deliveries instead of paying for staff to be vetted so they can work with children, it was claimed.

Under new rules, businesses face a £64 fee to register adults with the Independent Safeguarding Authority.

The Department for Children, Schools and Families insisted child safety was paramount.

The ISA’s scope had not been finalised, a spokesman said.

This is so incredibly unreasonable and dumb.  Or am I missing something I should have seen?
If this were an odd one off story, it would be bad enuff.  However, it isn’t.  This kind of bureaucratic madness has become a way of life.
It’s even gotten so that children have been taken from mothers with no evidence of harm or wrong doing, but simply on the theory based on some sort of survey or numbers, that the mom “MIGHT NOT be a suitable mother.”

How’s this for a headline:  ticket to an 82-year-old sufferer of Parkinson’s disease, who was asleep in a car, because her disabled parking badge was upside down.

Headmaster faces ban over fishing licence

As the respectable headmaster of a successful primary school, to be caught fishing with an out-of-date licence was admittedly a little embarrassing for Bob Yeomans.
But it was nothing compared with the consequences his oversight would have a few months down the line.

The 60-year-old head of St John’s Church of England Primary in Walsall, West Midlands, risks being banned from teaching after he was identified as having a criminal record by a government check designed to identify potential child abusers.
He faces a nervous wait while a local authority panel decides whether the concerns raised by the Criminal Records Bureau (CRB) warrant him losing his job.

(don’t touch that dial ... this gets better. Worse.)

Mr Yeomans, who has an otherwise impeccable record in 38 years as a teacher, was prosecuted after he went fishing at his favourite spot on the River Dove in Derbyshire last summer.

Asked by a water bailiff to produce his rod licence, he discovered to his horror that he had forgotten to renew it.

Fishing in a freshwater course without an Environment Agency rod licence is a criminal offence under the Salmon and Freshwater Fisheries Act 1975.

Mr Yeomans immediately pleaded guilty, was fined £50 and £70 costs by magistrates, and promptly forgot about the matter.

But officialdom had not finished with the popular head, whose 355-pupil school was rated “good with some outstanding features” in its latest Ofsted report last year.

Nearly a year after his illicit fishing trip he was confronted by a rather embarrassed chairman of governors who had been notified that his name had cropped up in an enhanced CRB check.

Although principally used to identify potential paedophiles, the checks pick up every contact a person has with the police. Mr Yeomans, who has been head of the school for 26 years, recalled: “The chair of governors was notified that there could be an issue with a CRB check in the school and rang to tell me. I said, ‘Is it a member of staff?’ and he said, ‘No, it’s you.’

“I was shocked. He had to visit me and, in effect, he was being asked if I was fit to work with children for forgetting to renew my rod licence.”

The chairman of governors was then required to submit a form to a local authority panel which decides if a member of staff flagged up by a CRB check can continue teaching. Mr Yeomans is still waiting on a decision but has not been suspended.

He told the Times Education Supplement: “It’s a bit of a joke in the school now. But if you think of the amount of time that was wasted filling in forms and on the phone, you’d have thought someone would have had some common sense at an earlier stage.It was just child protection gone mad. It was clear the offence was irrelevant.”

A spokesman for the Home Office, which is responsible for the CRB, defended the system.

“It is better and safer for any contact the person has had with the police to be mentioned. Otherwise, where do we know to draw the line?” he asked.

Mr Yeomans’s ordeal came to light as the National Association of Head Teachers is warning that the Government’s plan to keep almost all young people in education or training up to 18 could be hit by onerous and expensive CRB checks.

Employers could be put off accepting teenagers for work experience placements because they would have to pay between £31 and £36 for supervisors to undergo a CRB check, it is claimed.

So this woman is arrested okay? She deserved it but ….

There just isn’t a way to get the link and the whole article would bore you anyway.
It isn’t the arrest of this non-entity I’m concerned with.  It’s the totally insane use of law and language that has had me on simmer for a long time.

It also seems to be part of the politically correct cross we’ve all become accustomed to.

Will Rogers once said he only knew what he read in the papers, and at the moment I only know what our local paper has allowed me to know.  That the accused became violent and threatening, that she hit a couple of teen age girls, that she’s proven herself to be untruthful.  Yawn.

But what makes her case fall into the looney-tune moonbat catagory for me is the racial thing.  Unless the Hampshire Chronicle (Winchester,England) isn’t telling all, here’s what I have that just bothers the hell outta me because it doesn’t make any sense at all.

Apparently she has a record with the girls she punched.  She hit em back in Dec. and again more recently.  She has a record 12 years long, she’s a recovering drug addict, so we aren’t talking about Mary Poppins here.

She will spend two years in jail for all the offences.  She was given two months for the Dec. attack, and 18months for the most recent one.
She was given 4 months also for ....  “CAUSING RACIALLY-AGGRAVATED ALARM or DISTRESS” to the arresting officer.

The arresting officer it is reported, is of Czech descent.  I know you guys will be very quick to correct any error I make so feel free.

I thought a Czech would fall more under nationality then it would race.  BUT WAIT ....  You need to read exactly what the paper is reporting this woman said to the officer that falls into the racial crime catagory.  Here is the quote.

“YOU’RE NOT EVEN FROM THIS COUNTRY.  MY MUM PAYS TAXES FOR PEOPLE LIKE YOU.”

That’s it folks.  That’s the great racial insulting crime of the Winchester decade I suppose.

So, two months of her sentence for hitting ppl and 4 for what?  RACIALLY AGGRAVATED ALARM?

If saying the cop “isn’t even from this country” is stressful for the officer, what’s she gonna be like when she finds her first bloody body.  If she hasn’t already done so. 

Yes, I understand there are more pressing problems out there to worry about.  And I think Drew quite brilliantly laid out much in his editorial statement and the worries over BMEWS.  But this bit of insanity with the use of words and law has me quite sidetracked. 

The world is surely mad to come up with crap like, racially-aggravated alarm?

DC Cops back down on house search plan

D.C. police have scaled back plans to go door-to-door asking residents in high-crime neighborhoods whether officers can search their homes for guns as part of a new amnesty program aimed at getting weapons off the streets.

The Safe Homes program instead will be offered by appointment only at residents’ request, said Chief Cathy L. Lanier.

Lanier joined Mayor Adrian M. Fenty (D) last month in announcing the program and saying that police would begin work March 24 in the Washington Highlands area of Southeast Washington. In hindsight, officials said, more details should have been worked out before the announcement was made.

“I should have realized that the program needed to go out with a whole lot more information,” Lanier said. “I should have put it out with very clear facts.”

Lanier joined Mayor Adrian M. Fenty (D) last month in announcing the program and saying that police would begin work March 24 in the Washington Highlands area of Southeast Washington. In hindsight, officials said, more details should have been worked out before the announcement was made.

“I should have realized that the program needed to go out with a whole lot more information,” Lanier said. “I should have put it out with very clear facts.”

“The way it was announced by the mayor, so little had been worked out, and people were free to imagine the most intimidating sort of interaction with police, which nobody wants,” Mendelson said.

A Safe Homes program similar to the District’s was announced in Boston last week after several months of citizen resistance and delays. That department has yet to get a call to search a home.

“We’re still waiting for the phone calls to come in,” said Elaine Driscoll, spokeswoman for the Boston police.

Sure, sure, now we get it. You were just trying to help, that’s all. So sorry we misunderstood you. This new way is just fine then.

Um, maybe, maybe not. More likely not. This is still a police program that lets the cops play Daddy (en loco parentis) by request ... probably in a lot of homes that have no daddy ... and where the kids are totally out of control. Because good, responsible parents have no need of this program whatsoever. Am I right? If you’re at the point where you think your kid is stashing guns and drugs in his room, and you yourself feel so intimidated by your own child that you have to call in the cops to do something about it, then you’re a total failure as a parent and your kid is a mess. Is that the right way to look at this? Or is it that the Nanny State has become so overbearing that parents feel the need to call in the government to enforce discipline for them? If so, that’s an awfully sad state of affairs.
